Acceptance and Scope These Terms of Service ("Terms") govern your access to and use of ImmigrationOnMe, including immigrationonme.com, related applications, case dashboards, document tools, AI-assisted features, question-and-answer tools, drafting features, professional-referral services, and other services linking to these Terms (collectively, the "Services"). ImmigrationOnMe is a product and service operated by Nueve Technologies LLC ("Nueve Technologies," "ImmigrationOnMe," "we," "us," or "our"). For purposes of these Terms, "Nueve Parties" means Nueve Technologies LLC, ImmigrationOnMe, and, solely in connection with their work for or relationship to Nueve Technologies, its current and former members, managers, owners and equity holders, officers, directors, employees, agents, contractors, consultants, affiliates, subsidiaries, licensors, service providers, successors, and assigns. Independent attorneys, accredited representatives, consultants, or other professionals are not Nueve Parties merely because they are listed, matched, referred, or engaged through ImmigrationOnMe. By creating an account, accessing or using the Services, uploading documents, purchasing a paid feature, or otherwise indicating acceptance, you agree to these Terms, the ImmigrationOnMe Privacy Policy, and, when presented at registration or use of a covered feature, the ImmigrationOnMe User Registration, Consent & Data Authorization Agreement. If you do not agree, do not use the Services. 2. About ImmigrationOnMe ImmigrationOnMe is a technology platform designed to help users organize U.S. immigration matters, understand immigration documents and government correspondence, reconstruct case history, identify evidence gaps and deadlines, locate relevant official immigration information, prepare questions or drafts, track next actions, and connect with qualified professionals where appropriate. 3. Eligibility and Accounts • You must be at least 18 years old and legally able to agree to these Terms. • You must provide accurate account information and protect your credentials. • You may use the Services for another person only when you are lawfully authorized to do so. • You may not impersonate another applicant, petitioner, beneficiary, attorney, accredited representative, government officer, or other person. 4. No Government Affiliation ImmigrationOnMe is a private service. It is not U.S. Citizenship and Immigration Services (USCIS), the Department of Homeland Security (DHS), Executive Office for Immigration Review (EOIR), Department of State (DOS), Customs and Border Protection (CBP), Immigration and Customs Enforcement (ICE), Department of Labor (DOL), or any other government body, and it is not endorsed by those agencies unless expressly stated. 5. Nature of the Services • Document classification, extraction, comparison, evidence organization, and case reconstruction. • Plain-language explanation of notices, receipts, requests for evidence, decisions, correspondence, forms, and procedural records. • Identification of possible case posture, deadlines, missing evidence, contradictions, and next actions. • Retrieval and presentation of relevant official immigration authority and agency guidance. • AI-assisted Q&A and in-account case guidance. • Drafting of correspondence or response materials for user review where available. • Professional matching or referral services where available. The Services may identify possible procedural paths or issues, but immigration outcomes depend on verified facts, law, agency policy, discretion, evidence, procedural posture, and sometimes court or agency decisions. ImmigrationOnMe does not guarantee approval, eligibility, status, relief, a visa, admission, work authorization, a benefit, or any other immigration outcome. 6. AI-Assisted Features Some Services use AI and automated systems to extract document information, identify relationships, reconstruct timelines, retrieve relevant source material, generate candidate findings, draft explanations or correspondence, and plan next steps. AI can make mistakes. Important conclusions, dates, case status, eligibility, or legal consequences should be verified using official records and, when appropriate, a qualified immigration lawyer or accredited representative. 7. No Legal Advice or Attorney-Client Relationship ImmigrationOnMe is not a law firm and does not itself provide legal representation. Use of the Services does not create an attorney-client relationship. Information and AI-assisted analysis provided by ImmigrationOnMe are for informational and case-management purposes and are not a substitute for advice from a qualified immigration attorney or, where legally authorized, an accredited representative working through a DOJ-recognized organization. A separate attorney-client or representative relationship may arise only if you independently engage an authorized professional under that professional's own engagement agreement. Communications with ImmigrationOnMe itself are not automatically protected by attorney-client privilege or another professional privilege. 8. Immigration Information and Official Records ImmigrationOnMe may analyze receipts, notices, petitions, applications, decisions, requests for evidence, notices of intent, court notices, consular correspondence, identity documents, travel documents, case-status records, supporting evidence, and other immigration materials that you provide. The platform may infer relationships among records, but an AI-generated relationship is not an official government determination. 9. Deadlines and Case Status Immigration matters can involve strict and consequential deadlines. Government notices, court orders, statutes, regulations, and official case records control. Do not rely solely on a dashboard reminder, AI-generated date, or summary when a legal deadline is involved. If there is uncertainty about a deadline, removal proceeding, appeal, motion, detention matter, or other high-risk issue, seek qualified legal assistance promptly. 10. User Responsibilities • Provide truthful, complete, and current information to the best of your knowledge. • Review extracted facts and notify ImmigrationOnMe of errors. • Do not upload fabricated, altered, stolen, or unlawfully obtained immigration records. • Maintain your own copies of filings, notices, receipts, evidence, and correspondence. • Do not use the Services to evade immigration law, commit fraud, misrepresent identity, or submit false evidence. • Seek professional advice where legal judgment, representation, or high-risk deadlines are involved. 11. Document Uploads You retain ownership of documents and information you upload. You represent that you have the right to provide them and authorize ImmigrationOnMe and its service providers to process them to deliver the Services. You grant a limited, nonexclusive license to host, copy, parse, transform, analyze, display, and transmit uploaded content as reasonably necessary to operate, secure, and support the Services consistent with the Privacy Policy. 12. Professional Referrals and Legal-Service Boundaries ImmigrationOnMe may help users connect with immigration professionals. Only individuals authorized by law may provide immigration legal advice or representation. Depending on the forum and service, this may include licensed attorneys and accredited representatives associated with DOJ-recognized organizations. Non-lawyer immigration consultants, document preparers, or notarios are not authorized merely by that title to provide immigration legal advice. Unless expressly stated otherwise in a separate written agreement, participating professionals are independent from Nueve Technologies and are not employees, agents, partners, joint venturers, fiduciaries, or representatives of ImmigrationOnMe. A professional does not become a Nueve Party merely because the professional appears on, receives a referral from, or communicates through the platform. ImmigrationOnMe may use specialty, jurisdiction, language, experience, past-case categories, availability, and workload to assist matching. A recommendation, ranking, introduction, verification badge, or referral is not a guarantee of competence, authorization, availability, outcome, or legal eligibility. Any professional engagement is governed by a separate agreement between you and the professional. The professional, not Nueve Technologies, is responsible for the professional's legal advice, representation, filings, deadlines, confidentiality duties, strategy, professional judgment, and other independent acts or omissions. Professional fees may be separate from ImmigrationOnMe fees and should be disclosed before engagement. If you direct ImmigrationOnMe to share case information or documents with a selected professional, you authorize the transmission within the scope you approve. After delivery, the recipient may process the information under the recipient's own legal, professional, confidentiality, record-retention, and privacy obligations, subject to any contractual restrictions imposed by Nueve Technologies. 13. Government Filings and Representation Unless a specific Service expressly states otherwise under a separate agreement, ImmigrationOnMe does not file forms with USCIS or other agencies on your behalf, sign filings for you, enter an appearance, or represent you before DHS, EOIR, DOS, a court, or another authority. Drafts generated by the platform must be reviewed by you and, when appropriate, qualified counsel before submission. 14. Payments and Refunds Prices, subscriptions, flat fees, professional-referral charges, or other paid features will be disclosed before purchase. You authorize the designated payment processor to charge your payment method. Refund eligibility depends on the applicable product terms and the extent to which digital or professional services have already been performed. 15. Communications and Electronic Records You consent to electronic service communications, including security alerts, case updates, document-processing notices, deadline reminders, billing messages, professional-referral messages, and legal notices. Marketing communications are subject to separate preferences and applicable law. 16. Privacy The ImmigrationOnMe Privacy Policy describes how we collect, use, disclose, secure, retain, and delete personal information, including highly sensitive immigration and identity information. The Privacy Policy is incorporated into these Terms by reference. 17. Third-Party Services We may use third parties for hosting, authentication, payments, communications, document processing, AI, cybersecurity, analytics, or professional services. Third-party services may have their own terms. We are not responsible for independent third-party services outside our control, though we apply contractual and security requirements to service providers as appropriate. 18. Intellectual Property ImmigrationOnMe software, interfaces, workflows, designs, trademarks, databases, and proprietary content are owned by or licensed to ImmigrationOnMe and protected by law. You receive only a limited, revocable, non-transferable right to use the Services for their intended purpose. 19. Acceptable Use • Do not commit fraud, identity theft, document fabrication, unauthorized access, malware distribution, or any unlawful act. • Do not use the Services to create false evidence, false statements, or fraudulent immigration submissions. • Do not impersonate a government agency or authorized legal professional. • Do not circumvent security controls or access another user's case without authorization. • Do not scrape, resell, or exploit protected content except as permitted in writing. 20. Security We use administrative, technical, and organizational safeguards designed to protect personal information. You must promptly report suspected account compromise or unauthorized access. No system can guarantee absolute security. 21. Service Changes and Availability We may add, change, suspend, or discontinue features and may offer beta or preview functionality. We do not guarantee uninterrupted operation or that every document type, agency action, or legal issue will be correctly recognized. 22. Suspension and Termination You may stop using the Services or close your account subject to retention obligations. We may suspend or terminate access for violation of these Terms, fraud, misuse, nonpayment, security risk, legal requirements, or harm to other users or the platform. 23. Disclaimers TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." IMMIGRATIONONME DISCLAIMS WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AND UNINTERRUPTED AVAILABILITY TO THE EXTENT SUCH WARRANTIES MAY LAWFULLY BE DISCLAIMED. ImmigrationOnMe does not warrant approval of any filing or benefit, accuracy of every extracted fact, continued applicability of any agency policy, or that a government agency will act within an estimated timeframe. 24. Limitation of Liability TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE NUEVE PARTIES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, MULTIPLE, OR PUNITIVE DAMAGES; LOST PROFITS; LOST BUSINESS OR OPPORTUNITY; LOSS OR CORRUPTION OF DATA; LOSS OF GOODWILL; COST OF SUBSTITUTE SERVICES; IMMIGRATION CONSEQUENCES; GOVERNMENTAL DELAY; OR OTHER CONSEQUENTIAL LOSS ARISING OUT OF OR RELATING TO THE SERVICES, EVEN IF A NUEVE PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE NUEVE PARTIES ARE NOT RESPONSIBLE FOR LOSSES CAUSED SOLELY BY (A) INACCURATE, INCOMPLETE, OUTDATED, ALTERED, OR UNAUTHORIZED INFORMATION OR DOCUMENTS PROVIDED BY YOU OR A THIRD PARTY; (B) YOUR FAILURE TO REVIEW, CORRECT, FILE, RESPOND, APPEAR, APPEAL, MOVE, OR ACT BY AN APPLICABLE DEADLINE; (C) USCIS, DHS, EOIR, DOS, CBP, ICE, DOL, A COURT, CONSULATE, PAYMENT PROCESSOR, AI PROVIDER, CLOUD PROVIDER, OR OTHER THIRD PARTY ACTING OUTSIDE NUEVE TECHNOLOGIES' REASONABLE CONTROL; OR (D) THE INDEPENDENT PROFESSIONAL JUDGMENT, ADVICE, REPRESENTATION, FILING, OR OMISSION OF A PROFESSIONAL YOU CHOOSE TO ENGAGE. TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE AGGREGATE LIABILITY OF ALL NUEVE PARTIES, COLLECTIVELY, FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID DIRECTLY TO IMMIGRATIONONME FOR THE SERVICE GIVING RISE TO THE CLAIM DURING THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY OR (B) US$100. THE LIMITATIONS IN THIS SECTION APPLY REGARDLESS OF THE THEORY OF LIABILITY, INCLUDING CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, STATUTE, OR OTHERWISE, TO THE EXTENT PERMITTED BY LAW. NOTHING IN THESE TERMS EXCLUDES OR LIMITS LIABILITY THAT CANNOT LAWFULLY BE EXCLUDED OR LIMITED, INCLUDING LIABILITY ARISING FROM FRAUD, WILLFUL MISCONDUCT, OR OTHER NON-WAIVABLE OBLIGATIONS. 25. Indemnification To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless the Nueve Parties from and against third-party claims, demands, actions, investigations, losses, liabilities, judgments, settlements, penalties, damages, costs, and reasonable attorneys' fees arising out of or relating to: (a) your unlawful, fraudulent, abusive, or unauthorized use of the Services; (b) your material breach of these Terms, the Registration Agreement, or another agreement governing your use of ImmigrationOnMe; (c) information, documents, credentials, identities, passports, A-numbers, receipt numbers, government records, declarations, family information, or other materials you submit, direct us to process, or direct us to share without sufficient legal authority; (d) your infringement, misappropriation, or violation of another person's privacy, confidentiality, intellectual-property, publicity, contractual, or other rights; (e) false, materially inaccurate, misleading, forged, altered, or fraudulent information you knowingly or recklessly provide; (f) your violation of immigration, privacy, fraud, identity-theft, sanctions, export-control, or other law; (g) your instructions to transmit information or documents to a professional, service provider, government agency, or other recipient where the claim arises from your lack of authority to give that instruction; or (h) a dispute between you and an independently engaged attorney, accredited representative, consultant, or other third party to the extent the dispute arises from that party's independent acts or omissions rather than conduct legally attributable to a Nueve Party. Nueve Technologies may, at its option, assume control of the defense of a matter subject to indemnification. You agree to provide reasonable cooperation. You may not settle an indemnified claim in a manner that admits wrongdoing by, imposes obligations on, or restricts the rights of a Nueve Party without Nueve Technologies' prior written consent. This indemnification obligation does not require you to indemnify a Nueve Party to the extent a final, non-appealable determination establishes that the claim was caused by that Nueve Party's own fraud, willful misconduct, gross negligence where it cannot lawfully be disclaimed, or other violation of law for which indemnification is prohibited. 26. Disputes and Governing Law PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS HOW DISPUTES WITH NUEVE TECHNOLOGIES AND THE OTHER NUEVE PARTIES MAY BE RESOLVED. Before filing a formal claim, you and Nueve Technologies agree to attempt in good faith to resolve the dispute informally for at least 30 days after written notice describing the dispute, relevant account information, and requested relief is sent to legal@immigrationonme.com. Except for claims eligible for small claims court, claims seeking temporary or emergency injunctive relief relating to security, misuse, confidentiality, or intellectual property, and matters that applicable law does not permit to be arbitrated, any dispute, claim, or controversy arising out of or relating to these Terms, the Registration Agreement, the Services, or your relationship with any Nueve Party will be resolved by binding individual arbitration. Unless the parties agree otherwise in writing, arbitration will be administered by the American Arbitration Association under its applicable Consumer Arbitration Rules. The Federal Arbitration Act governs the interpretation and enforcement of this arbitration provision. YOU AND THE NUEVE PARTIES AGREE THAT CLAIMS WILL BE BROUGHT ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN A PURPORTED CLASS, CONSOLIDATED, COLLECTIVE, MASS, OR REPRESENTATIVE ACTION, TO THE EXTENT PERMITTED BY LAW. You may opt out of the arbitration and class-action waiver by sending written notice to legal@immigrationonme.com within 30 days after first accepting the version of these Terms containing this arbitration provision. Your notice must identify your account and clearly state that you opt out of arbitration. Opting out does not affect your ability to use the Services. These Terms are governed by the laws of the State of Texas, without regard to conflict-of-laws principles, except where federal law or another jurisdiction's mandatory law applies. For disputes that are not subject to arbitration and are not properly brought in small claims court, you consent to the exclusive jurisdiction and venue of courts of competent jurisdiction located in Harris County, Texas, unless applicable law requires otherwise. 27. Changes We may update these Terms as the Services, law, or practices change. We will post the updated version and revise the Last Updated date. Material changes will receive additional notice where required by law. 28. Miscellaneous ImmigrationOnMe is a product and service of Nueve Technologies LLC and is not, by itself, a separate legal entity. Except where a separate written agreement expressly states otherwise, contractual obligations relating to the Services are obligations of Nueve Technologies LLC and not personal obligations of any member, manager, owner, equity holder, officer, director, employee, contractor, or agent solely because of that person's relationship to Nueve Technologies. The Nueve Parties are intended third-party beneficiaries of, and may enforce, provisions of these Terms that expressly protect or benefit them, including disclaimers, releases, limitations of liability, indemnification, dispute-resolution provisions, and restrictions on misuse. If a provision is unenforceable, the remaining provisions remain effective, and the unenforceable provision will be modified or severed to the minimum extent necessary to make it enforceable where permitted by law. Failure to enforce a provision is not a waiver. You may not assign these Terms without our consent except where law provides otherwise. We may assign them in connection with a merger, financing, reorganization, acquisition, corporate restructuring, or sale of assets.
